You remember that post about the homestuck t-shirt design contest collaborating with hot topic? And how Hot Topic are the biggest art thieves? This is recent. As you can see above, I stumbled upon Hot Topic’s website and they are selling a very popular fan art put on a t-shirt, and did not ask permission from the original artist (rismo).
This shows Hot Topic still continues their art thievery. Hot Topic are still taking art from artists without their permission. This is disrespectful and appalling.
EXCEPT YOU DID GIVE THEM YOUR PERMISSION.
BY AGREEING TO TERMS AND CONDITIONS ON DEVIANT ART.
THEY SOLD IT TO A THIRD PARTY ROYALTY-FREE.

This is basically why companies like Hasbro can get away with art theft, like the whole fanart theft thing that happened last year
Definitely a good idea to check terms and conditions.
If a service is free you can be sure the assholes who run it pull some kind of bullshit like this to make the money necessary to run the place.
Before exploding, please actually read the agreement. While deviantART basically gives itself totally free reign to use your materials for promotional purposes and to use it in compilation works for profit, section 5 of the agreement is pretty cut and dry.
“5. Limitation Of Rights The rights and licenses granted to deviantART under sections 3 and 4 of this Agreement require deviantART to obtain Artist consent before deviantART makes any commercial agreement with anyone else to separately buy, license, re-sell or re-publish or commercially use any Artist Materials not in association with deviantART but as an individual work of art or as a group of works from a single Artist in isolation from any other works. No additional consent is required for any other licensed uses under this Agreement of Artist Materials either as part of the deviantART Site(s) or in connection with the distribution of content groups from the deviantART Site(s) and/or for uses of the Artist Materials made at the discretion of a visitor to the deviantART Site(s) or other users under agreements with deviantART. deviantART will contact Artist in writing about any individual commercial uses of Artist Materials instigated by deviantART.”
DeviantART would be blatantly violating its own agreement if it sold rights to any third party without first acquiring written permission from the artist. Don’t blame dA For this shenanigan. This is Hot Topic being first class fuckers yet again. Don’t let yourself be derailed by uninformed rumors.
